Former Malibu Media attorney Paul Nicoletti found guilty on four counts of bank fraud
Former attorney Paul Nicoletti
Today, after deliberating for about 1.5 hours, a Detroit jury found a former porn copyright troll Paul Nicoletti (X-Art / Malibu Media) guilty on four counts of bank fraud. This prosecution was not related to Nicoletti’s porn trolling activity, although these events were not surprising: copyright trolling attracts all kinds of shady people.
Nicoletti was indicted in June 2015. After that, in what appears to be attempts to game the system, he managed to secure a delay after delay: I lost the count of judge’s orders to postpone trial and how many public defenders Nicoletti fired to buy more time.
I covered the indictment and subsequent events until I stopped about a year ago. If you are curious, you can fill the gaps by looking at the docket: you’ll find some interesting documents there (e.g., this one).
In this case the proverbial wheels of justice have been grinding particularly slow.
The sentencing was set to 9/24/2019.

6/4/2019
On 5/29/2019, the Michigan Disciplinary board automatically suspended Nicoletti’s law license. In the meantime, Nicoletti stays defiant and plans to file a Rule 29(c) Motion for a Judgment of Acquittal.

Yesterday Paul Nicoletti was sentenced to 70 months in federal prison + 2 years of supervised release and has to pay $5.3 million in restitution.

Nicoletti now filed a Motion for Reconsideration submitted by Attorney Stablein insinuating that Mr. Nicoletti doesn’t have funds to pay over $5,000,000.00 (that is over $5 Million). Where did all his ill-gotten gains go?
At the time of the crime, Nicoletti’s real estate was titled under Mary Ann White Nicoletti who was also an officer in Continental Title. I would think she should be named as an unindicted co-conspirator as well as his flying monkey in this legal circus.
He continues to make a mockery of the court system at tax payer expense.

Nicoletti stated on the record his family supports hm, (as they are the recipients of his ill-gotten gains.) Mary Nicoletti was a principal in the conduit of Continental Title and continues to support him as an un-indicted co-conspirator.
It is common knowledge that the towing business in S.E. Michigan has the appearance of an organized crime syndicate.

According to the 6th Circuit Court of Appeals , Stablein’s representation ENDED on 3/4/20, yet Nicoletti’s Motion for Reconsideration entered into the record on 6/17/20 states it was “Respectfully submitted by Pal J. Stablein” P42544
Could Nicoletti have authored this Motion himself and surreptitiously, used Stablen’s name, and why not his new attorneys from TN, Donald Capparella and Tyler Chance Yarbro his attorneys of record at the 6th Circuit Court of Appeals?
Is Nicoletti pettifogging by referencing a supervised release which is granted AFTER prison time according to the Federal Prison information?

Delays and more delays, neck surgery, COVID-19….. he was convicted in May 2019 yet doesn’t have to report to the Bureau of Prisons until Jan 1st 2021, another 19 months of freedom he doesn’t deserve. Mr. Nicoletti argues that he should not be in prison due to COVID-19, yet he is allowed to travel by airplane (considered a flying petri dish for Covid-19) to Florida and Colorado. Florida is the 4th highest state with Covid-19 cases, and then on to Colorado which is in the top half of all states with active COVID cases, ranked 24 out of 50 states.

Nicoletti put on the record that his only income is $420 week from a towing company but did not produce income tax returns. Were these “under the table” earnings, and if so, was this an understatement?
The record states his monthly income is about $1680 per month, but his monthly expenses are over %6,000 per month with an almost $5000 monthly deficit. What ever happened to living within one’s means? The new M.O. appears to be over-extending credit cards and then defaulting resulting in lawsuits where credit card companies are the losers.
He also put on the record that his family supports him which would include all his dysfunctional, criminal behaviors manifesting in ill-gotten gains from which the Nicolettis benefited, including cruises, vacations, weddings, real estate and presumably much, much more.
why aren’t they going after him/them for transferring his assets to his wife?

Nicoletti is the principal in Continental Title Company and an attorney. He knew or should have known. The history of his schemes and misrepresentations establish that the best predictor of future behavior is past behavior. Just look at the record of all his civil cases in Oakland County Circuit. The history shows Nicoletti doesn’t do anything without knowing to cause parties to part with their money and obtain ill-gotten gains.

Fraud lands man in prison

A federal judge on Wednesday sentenced a Northville lawyer who defrauded friends and neighbors of millions of dollars to five years and four months in federal prison.
U.S. District Judge Victoria A. Roberts rejected testimony from an expert witness who said Charles G. Mady was a pathological gambler who played the commodities market instead of the slot machines and was not fully responsible for his actions.
Roberts sentenced Mady, 36, at the top of the federal sentencing guidelines range for embezzlement, and ordered him to pay about $8.5 million in restitution to his victims.
“What you did to the victims in this case is just a horrific set of circumstances,” Roberts told Mady.
“The court finds you to be totally unsympathetic.”
The court heard from victims who said they trusted Mady and lost millions of dollars while he sent them statements showing their investments were increasing in value. Some even paid taxes on income they thought they had earned, while they were losing money.
The government alleged Mady converted more than $3 million of investors’ money to his own uses, including buying racehorses and luxury cars.
Mady, a Canadian citizen, is expected to be deported after he completes his sentence.

In all his brilliance, hasn’t he figure out that he was indicted in 2015 and if he would have allowed the case to normally progress and be sentenced, assuming his prison term would be the same 60 months, his prison sentence would be behind him now, instead of making it a post-career choice.

When you’re an attack dog for the cult of copyright, you start to think of yourself as invincible. After all, the RIAA and MPAA were allowed to run roughshod over the population with having no evidentiary standards or need to prove their IP address harvesting was actually accurate, so why should porn companies and their lawyers ever need to live under the ignominy of being scrutinized?
For Nicoletti, it’s not just about the shame of taking the hit – it’s the fact that he’ll never work in this highly lucrative field of legal extortion, and the misguided principle of the thing. Nicoletti refuses to live down the fate of Paul Hansmeier, the latter who is still fighting for his right to operate as a copyright troll. For these parasites it’s all in or nothing.

All federal prisons are required by statute and regulations to have a law library. This used to consist of a room filled with legal texts, but the technological age has arrived within the Federal Bureau of Prisons. Now, all federal inmates have access to the TRULINCS computer system, which contains a full electronic law library. By most accounts, this is a huge improvement.
The law library computers allow inmates to electronically access case-law from all federal courts, Federal Bureau of Prisons program statements (BOP policy), and various other legal resources (including a law dictionary, the Federal Rules of Criminal Procedure, the Federal Rules of Civil Procedure, Code of Federal Regulations, etc.). One of the terrific features about this electronic law library is that it is searchable. Thus, an inmate can type in a specific term and a hit list is provided to them. This makes legal research efficient and easy to manage.

>>> One day his entire squadron was sent on a mission. After he was airborne, he looked at his fuel gauge and realized that someone had forgotten to top off his fuel tank.

>>> His flight leader told him to return to the carrier. Reluctantly, he dropped out of formation and headed back to the fleet.

Upon arrival, he reported in and related the event surrounding his return. The film from the gun-camera mounted on his plane told the tale. It showed the extent of Butch’s daring attempt to protect his fleet. He had, in fact, destroyed five enemy aircraft. This took place on February 20, 1942, and for that action Butch became the Navy’s first Ace of W.W.II, and the first Naval Aviator to win the Medal of Honor.

>>> A Year later Butch was killed in aerial combat at the age of 29. His hometown would not allow the memory of this WW II hero to fade, and today, O’Hare airport in Chicago is named in tribute to the courage of this great man.
