Attorney, who has been bastardizing the litigation process for years, gets offended by the word “bastardize”

While I was concentrating on John Steele’s outfit, I’m afraid other trolls have been feeling neglected, especially a mega villain Keith Lipscomb. To rehabilitate myself, I looked into my backlog and found this gem.


Back in November, in a slow-moving class action lawsuit (Jennifer Barker and Sabree Hutchinson v. Copyright Trolls, KYWD 12-cv-00372), plaintiffs’ attorney Kenneth Henry used a pretty mild description of what Keith Lipscomb and his gang have been doing for about two years:

To bastardize the litigation process and abuse the court system as the Defendants have done, and now to object to the taking of early discovery vis-à-vis their claim that this Court lacks personal jurisdiction over them is yet another display of the Defendants’ total disregard for the courts and the rights of those with whom they deal.

In my (and not only my) opinion, Mr. Lipscomb’s “business” is better described as an extortion racket rather than a mere “bastardization of the litigation process.” Yet Lipscomb took an offense and demanded to strike that reasonable assessment from Henry’s motion:

Plaintiffs repeated accusations that Defendants are “bastardiz[ing] the litigation process” and have purposefully abused the court system in order to harass innocent individuals nationwide are baseless and unwarranted.

[…]

Accordingly, the language “bastardization of the litigation process” should be struck.

And this is not ironic enough: this man shakes down many thousands (a significant part of whom are innocent) over obscene material; his evidence is flimsy at best; and his fee-splitting agreements with porn purveyors and unlicensed foreign IP address harvesters are undeniably unethical. This man, in addition to having become furious over a dictionary word, was also offended when Henry called him “obviously not a Biblical scholar”:

[…] the first page of Plaintiffs’ reply exclaims, “[o]bviously, counsel for the Defendants are not Biblical scholars.” This is deeply offensive. Undersigned was raised a Christian, was active in Campus Life and Campus Crusade (now known as “Cru”) in high school and college respectively, and used undersigned’s only preemptory waiver to ensure enrollment in an always oversubscribed biblical law class while attending The Cornell Law School. Undersigned is currently a member in good standing of the First Presbyterian Church in Fort Lauderdale, Florida and is a regular attendee at services.

 

Here we are: an indefinitely greedy person who indiscriminately assaulted many elderly, poor and sick, a person who lies each time he opens his mouth, a coward who loves to spill his saliva threatening fellow attorneys, demonstrates that he has a thin skin in unexpected places.

It evades me how this man can reconcile his purported Christianity with the fact that the public in general reasonably thinks that copyright trolling is a labor of Satan. Maybe people of faith chime in and explain. Until then I cannot get rid of the vision of Lipscomb’s famous relative turning in his grave.

Question for the community

Given the passionate and articulate pleading embedded above, it seems that M. Keith Lipscomb manages to conflate two incompatible things: a Christian worldview and “theft via extortion” (a.k.a. porn copyright trolling). I meditated on this paradox and cannot think about but two explanations, unless I am totally wrong. What do you think?

  1. I plan on posting a link to this assholes work in the church bulletin in Ft. Lauderdale. What a sorry excuse for a man. And I always thought Lipscomb was a Jewish name. Boo hoo hoo. Somebody called me a name. What a dick.

    • If he is as heavily involved in his church as he claims and was honest with the name and location he just gave the entire world great ammo at destroying his social life. While Presbyterian ministries tend to be rather liberal in the context of churches, his community would no doubt take great offense to what he does and there’s even a relative chance of him targeting someone in his congregation.

      • It would be a public service to alert his congregation to his moral deficiency.

        Prostitution is clearly forbidden by the Bible, and there is no way to convincingly argue that porn production is anything but prostitution, irrespective of legal distinctions. Furthermore, even if Lipscomb believes in principle that everyone is entitled to legal representation, it does not oblige him to take clients that run a business antithetical to his beliefs. In his case, it is not simply a matter of failing to politely decline a business proposal, he is proactively seeking these clients and building a business of blackmail and extortion on top of their moral transgressions.

        We know from his litigation tactics and email correspondences that have appeared on dockets that he is not a kind or professional man, he is a cruel, aggressive, impolite bully. A wolf in sheep’s clothing!

        Can you imagine having your child exposed to this guy’s “mentoring” in church activities, etc?

        He is poisonous. Playing victim and faking religious faith as a means of appearing respectable are hallmarks of the sociopath.

  2. Oh Christ (irony intended)! As a godless atheist, I do not even know where to begin. First off, a readiness to believe in fairy tales may make someone susceptible to the “magic” that an IP address equals an infringer and the harvesting program is infallible. Also, Kotzker is also a kneeler and, like Lipscomb, REALLY enjoys his work. My hypothesis for awhile is that these guys truly believe they are doing God’s work in punishing alleged viewers of pornography (the alleged infringement is secondary), like avenging angels. BTW the money is good, so Thor, err I mean God, must be on their side. Consequently these guys remind me of the Westboro Baptist Church congregation. God fearing assholes who equate their beliefs with a justification to make others miserable and profit at the same time. If there were truly a Christian God he would be carving out a special place in Hell for these parasites.

    BTW – Quite sure the boys over at Prenda are not the least bit burdened by theological quanderies as we all know what they wor$hip.

  3. and on the 7th day God said – “go forth and attack 30% or more innocent people in mass litigation extortion by holding the threat of 150,000 dollars or (or additional) costs of retaining a lawyer at ~350-600 dollars an hour all under the premise of bittorrenting explicit hardcore porn and gay porn (both guy/guy and girl/girl)” – and so they did.

    Yeah. Sounds like what I learned in church.

    Hasn’t a judge, in at least one case I can remember where these morons tried to take the ‘moral high ground’ called the pornotrolls out on attempting to take a moral high ground whilst litigating for teenager porn copyrights?

  4. IMO, considering the way Christianity is practiced these days, there is no problem with being a Christian porn copyright troll. The one true god of the USA is the $$, and it says so on every bill in your wallet. I doubt there will be much if any negative response from his church, if anyone bothers to contact them.

  6. See, this is another reason why even talking about my religion makes me uncomfortable. How the hell can anyone loudly proclaim “I’m a Christian” with a straight face with scumsucking jerks like these walking the same streets as decent humans do?

  8. i hate to bring christianity into this, but the bible have some VERY CLEAR passages about these types of situations, and he opened the door….. for example:

    1 Corinthians 6
    New International Version (NIV)

    If any of you has a dispute with another, do you dare to take it before the ungodly for judgment instead of before the Lord’s people? 2 Or do you not know that the Lord’s people will judge the world? And if you are to judge the world, are you not competent to judge trivial cases? 3 Do you not know that we will judge angels? How much more the things of this life! 4 Therefore, if you have disputes about such matters, do you ask for a ruling from those whose way of life is scorned in the church? 5 I say this to shame you. Is it possible that there is nobody among you wise enough to judge a dispute between believers? 6 But instead, one brother takes another to court—and this in front of unbelievers!

    this is a very well known passage and i would think that any person who was contemplating seminary and/or lawschool would be even more familiar with this biblical concept. he is a hypocrite and scum and his lies fall on deaf ears.

    • I agree with your sentiments, but that group of verses is directed specifically at “believers” who abuse their fellow believers by committing the above wrongs. It is not directed at “believers” who are taking an outsider to court. This is how wrongs are committed in the name of Christ, and how atrocities are allowed to be committed large scale, by taking verses out of context and applying them wholesale to situations they were never intended to by applied to.

  9. What I find impressive is how everyone totally ignores the fact that the accusation wasn’t that he wasn’t a Christian, but that he wasn’t a Biblical scholars. MOST christians aren’t biblical scholars. Even some christian college professors wouldn’t claim that title. But Lipscomb ignores the scholar point, choosing instead to make it sound that the filing contained an attack against his religion. Typical.
